SUMMARY OF ORDINANCE 26-06

NOTICE IS HEREBY GIVEN that at its regular meeting on August 19, 2026, at 7:00 p.m., the Board of Directors of the Moraga-Orinda Fire Protection District (“District”) intends to adopt the following ordinance:

AN ORDINANCE OF THE MORAGA-ORINDA FIRE PROTECTION DISTRICT, AMENDING THE PURCHASING AND CONTRACTING PROCEDURES AND AUTHORITIES TO ELECT TO USE THE UNIFORM PUBLIC CONSTRUCTION COST ACCOUNTING ACT PROCEDURES; AND TO AUTHORIZE, BY RESOLUTION, ESTABLISHMENT OF AUTHORITY AND PROCEDURES FOR (1) CONTRACTING FOR REPAIR OR REPLACEMENT OF A PUBLIC FACILITY IN THE EVENT OF AN EMERGENCY AS DEFINED IN PUBLIC CONTRACT CODE SECTION 1102; AND (2) FOR EXPENDITURE OF DISTRICT FUNDS DURING A MAJOR EMERGENCY INCIDENT WHEN IMMEDIATE ACTION IS NECESSARY TO PROTECT LIFE, PROPERTY, CRITICAL INFRASTRUCTURE, AND THE COMMUNITY.

SUMMARY OF THE PROPOSED ORDINANCE:

The District previously adopted Ordinance No. 24-03 restating and amending purchasing and contracting procedures and Ordinance No. 26-05 authorizing design-build and progressive design-build project delivery methods as permitted by the California Public Contract Code. Ordinance 26-06 would supersede Ordinance 26-05 and amend the District’s purchasing and contracting procedures to elect to use the Uniform Public Construction Cost Accounting Act (“UPCCAA”) procedures for public projects. The ordinance would allow eligible public projects to be performed by force account, negotiated contract, purchase order, informal bidding, or formal bidding, as applicable, based on the thresholds established in the UPCCAA and Public Contract Code section 22032, as amended from time to time.

The ordinance would authorize the Fire Chief to develop and maintain a list of qualified contractors and to award informal contracts as permitted by law and District policy. The ordinance would also authorize the Board, by resolution, to establish authority and procedures for contracting for repair or replacement of a public facility in the event of an emergency and for expending District funds during a major emergency incident when immediate action is necessary to protect life, property, critical infrastructure, and the community. The ordinance restates purchasing authority levels, exceptions to bidding, protest procedures, and related purchasing requirements. The ordinance also includes a finding that adoption is exempt from the California Environmental Quality Act because the amendments modify administrative contracting procedures. If adopted, the ordinance will take effect 30 days after passage.
