BOARD OF DIRECTORS
ORDINANCE NO. 25-03, DESIGNATING FIRE HAZARD SEVERITY ZONES,
ESTABLISHING AN URBAN WILDLAND INTERFACE COMMUNITY, AND
DETERMINING THE ORDINANCE IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT.

NOTICE IS HEREBY GIVEN that at its meeting held on May 21, 2025; the Board of Directors of the Moraga-Orinda Fire Protection District adopted Ordinance No. 25-03, Designating Fire Hazard Severity Zones, Establishing an Urban Wildland Interface Community, and Determining the Ordinance is Exempt from the California Environmental Quality Act. by the following vote:

SUMMARY OF THE ORDINANCE:
- Fire Hazard Severity Zone Adoption: Pursuant to Government Code section 51178, the State Fire Marshal identified areas within the Fire District as moderate, high, and very high fire hazard severity zones and provided its recommendations to the Fire District on February 24, 2025. Pursuant to Government Code section 51179, local agencies are required to designate, by ordinance, the Fire Hazard Severity Zones in their jurisdiction within 120 days of receiving the recommendations from the State Fire Marshal. Local agencies may not reduce the severity levels assigned by the State Fire Marshal; however, they may increase the designation levels in accordance with law. Ordinance 25-03 adopts, without change, the Fire Hazard Severity Zone recommendations provided by the State Fire Marshal and received by the Fire District on February 24, 2025.
- Designation of the District as an Urban Wildland Interface Community: Pursuant to Health & Safety Code section 13108.5(c), Ordinance 25-03 will designate the entire District as an Urban Wildland-Interface Community based on the findings in the Ordinance. With this designation, the entire Fire District shall be subject to the Home Hardening Building Standards established by Health & Safety Code section 13108.5. The Home Hardening Building Standards are currently located in Chapter 7A (Materials and Construction Methods for Exterior Wildfire Exposure) of the 2022 California Building Code, Title 24, Part 2, Volumes 1 and 2 of the California Code of Regulations, and Section R337 (Materials and Construction Methods for Exterior Wildfire Exposure) of the 2022 California Residential Code, Title 24, Part 2.5 of the California Code of Regulations, as amended by the July 2024 Supplement, and are subject to further amendment by the State Fire Marshal.
CEQA DETERMINATION: Ordinance 25-03 includes findings that the proposed ordinance is exempt from the California Environmental Quality Act (CEQA) for the reasons stated in the proposed ordinance.
This ordinance shall take effect and be in full force 30 days after its passage.
