
NOTICE OF PUBLIC HEARING BY THE
MORAGA-ORINDA FIRE PROTECTION DISTRICT

NOTICE IS HEREBY GIVEN that the Moraga-Orinda Fire Protection District Board of Directors will hold a Public Hearing to consider adoption of the following proposed ordinances.
PROPOSED ORDINANCE 26-01 — FIRE CODE
AN ORDINANCE OF THE MORAGA-ORINDA FIRE PROTECTION DISTRICT OF CONTRA COSTA COUNTY, CALIFORNIA, ADOPTING THE 2025 EDITION OF THE CALIFORNIA FIRE CODE, INCLUDING SPECIFIED APPENDICES, AND AS MODIFIED, WITH LOCAL AMENDMENTS, AND BY REFERENCE, THE INTERNATIONAL FIRE CODE, 2024 EDITION, PUBLISHED BY THE INTERNATIONAL CODE COUNCIL, AND REPEALING ORDINANCE 23-01, ADOPTING FINDINGS SUPPORTING THE LOCAL AMENDMENTS, AND ADOPTING A FINDING THAT THE ORDINANCE IS EXEMPT FROM REVIEW UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT.
PROPOSED ORDINANCE 26-02 — WILDLAND-URBAN INTERFACE (WUI) CODE
AN ORDINANCE OF THE MORAGA-ORINDA FIRE PROTECTION DISTRICT OF CONTRA COSTA COUNTY, CALIFORNIA, ADOPTING THE 2025 CALIFORNIA WILDLAND-URBAN INTERFACE CODE, INCLUDING SPECIFIED APPENDICES, AND AS MODIFIED WITH LOCAL AMENDMENTS, AND ADOPTING A FINDING THAT THE ORDINANCE IS EXEMPT FROM REVIEW UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT.
SUMMARY OF THE PROPOSED ORDINANCES
Ordinance 26-01 – Fire Code: Every three years, new editions of the state building codes are published. The new codes and local amendments reflect changes in technology, fire safety techniques, and the building industry. These codes become the minimum standards for the State of California on January 1, 2026. The proposed ordinance reflects local amendments with more restrictive building standards reasonably necessary because of local climatic, geological, or topographical conditions. By adopting the proposed ordinance, the Moraga-Orinda Fire Protection District will be enforcing a code that is consistent with state regulations. Under state law, after the first reading of the title of the proposed ordinance, which occurred on November 19, 2025, the District is required to hold a public hearing before the proposed ordinance is adopted. After the hearing, the Board of Directors may amend, adopt, or reject the proposed ordinance.
Ordinance 26-02 – Wildland-Urban Interface (WUI) Code: Ordinance 26-02 adopts the 2025 California Wildland-Urban Interface Code, along with local amendments and findings required under state law. These standards are intended to improve wildfire resilience and apply certain standards District-wide based on local climatic, topographical, and geological conditions. By adopting the proposed ordinance, the Moraga-Orinda Fire Protection District will be enforcing a code that is consistent with state regulations. Under state law, after the first reading of the title of the proposed ordinance, which occurred on November 19, 2025, the District is required to hold a public hearing before the proposed ordinance is adopted. After the hearing, the Board of Directors may amend, adopt, or reject the proposed ordinance.
CEQA DETERMINATION: The Board of Directors will consider adopting a finding that both proposed ordinances are exempt from review under the California Environmental Quality Act (CEQA) for the reasons as stated in each ordinance.
All interested persons are invited to attend the public hearing on January 21, 2026, at 7:00 p.m. at the Orinda Library Auditorium, 26 Orinda Way, Orinda, CA 94563. The meeting will be held in a hybrid format, and the public may participate in person or remotely. Zoom or other virtual format participation details will be provided on the published January 21, 2026, Board of Directors meeting agenda.
Written comments regarding the proposed environmental findings and/or merits of the proposed ordinances are encouraged prior to the public hearing. Please note that any challenge of the proposed action in court may be limited to addressing only those issues raised at the public hearing described in this notice, or in written correspondence submitted to the Moraga-Orinda Fire Protection District’s District Clerk at or prior to the public hearing.
